CastonCASTON PROFESSIONAL USER AGREEMENT
This Agreement governs access to and use of the Caston platform by persons or organizations granted professional access by Caston.

1. Professional Users
A Professional User means a casting director, producer, production company, director, advertising company, agency or other professional person or organization operating in casting, production, media, advertising, film, television or related industries who has been granted access by Caston. Professional accounts are not available for unrestricted public registration.
2. Purpose of Professional Access
Caston provides limited access to actor and candidate profiles for legitimate casting, audition, project evaluation, talent selection and directly related professional purposes. Professional access does not transfer ownership of the Caston database or candidate information.
3. Confidentiality of Candidate Profiles
Candidate profiles are not publicly accessible. Professional Users acknowledge that information accessed may include non-public photographs, videos, contact information, physical characteristics, professional information, skills, experience and information concerning child and baby candidates, and may use it only for legitimate professional purposes.
4. Permitted Use
Candidate information may only be used for casting, auditions, talent selection, evaluation for advertisements, films, television productions, digital content and other productions, searching for candidates for specific roles/projects and contacting suitable candidates for legitimate professional purposes.
5. Contacting Candidates
Professional Users may contact candidates using contact information voluntarily provided through the profile. They must accurately identify themselves and their organization, avoid misleading project information, refrain from harassment, threats, coercion, discrimination or exploitative conduct, and use contact information solely for legitimate professional purposes. Caston is not a party to agreements between Professional Users and candidates.

6. Copying and Transfer of Data
Professional Users must not:
- Copy the entire Caston candidate database or a substantial portion of it
- Systematically download candidate information
- Use scraping, crawling, bots or automated data collection tools
- Create an independent candidate database from Caston information
- Sell candidate information or convert it into a commercial data product
- Transfer candidate information to third parties for unrelated purposes
- Publicly publish candidate profiles
7. Screenshots, Photographs and Videos
Professional Users must not save, publish, distribute through social media or otherwise use candidate photographs, videos or profile content outside legitimate professional purposes. Limited storage or sharing that is reasonably necessary for a casting or production process must remain limited to that purpose and comply with applicable law.
8. Child and Baby Candidates
Professional Users must exercise particular care when processing information relating to minors. Communications should be conducted through the parent or legal representative contact information; inappropriate or unauthorized direct communication with a child is prohibited; child content must not be publicly published without proper authorization; and no conduct may endanger a minor's safety, privacy or welfare. Caston may immediately suspend or terminate access where a child safety risk exists.
9. Account and Password Security
Professional credentials are personal to the authorized individual or organization. They must not be shared, sold or transferred, and third parties may not be allowed to use the account. Suspected unauthorized access must be reported to Caston promptly.
10. Protection of Personal Data
Professional Users agree to use personal data accessed through Caston in accordance with Law No. 6698 (KVKK) and other applicable data protection laws. Where a Professional User independently processes data obtained through Caston for its own purposes, it is responsible for legal obligations applicable to that processing.
11. Confidentiality Obligation
Professional Users must protect the confidentiality of non-public candidate information. This obligation continues after access ends while the information remains non-public or another lawful basis for retention/processing does not apply.
12. Prohibited Conduct
Professional Users must not:

- Provide fraudulent or materially misleading project information
- Defraud or attempt to defraud candidates
- Request money from candidates for purposes unrelated to legitimate Caston activity
- Harass, threaten or exploit candidates
- Endanger child candidates
- Copy the Caston candidate database
- Circumvent Platform security or access unauthorized accounts/data
- Use Caston information to create marketing lists
- Transfer candidate information for unauthorized commercial purposes
- Use the Platform for unlawful purposes
13. Caston's Right to Suspend or Terminate Access
Caston may maintain access and security logs in accordance with applicable law. It may suspend access where it reasonably suspects a violation of this Agreement, misuse of candidate information, unauthorized credential sharing, child safety risk, Platform security compromise or unlawful activity. Serious or repeated violations may result in permanent termination.
14. Data Breaches and Security Incidents
Professional Users must promptly notify Caston at info@castonapp.com if candidate data is accessed by an unauthorized person, lost, unlawfully disclosed, affected by account compromise or otherwise involved in a security incident.
15. Intellectual Property
The Caston name, trademarks, logo, software, design, database structure, interface and original materials are owned by Caston or applicable rights holders. Professional access does not transfer intellectual property rights.
16. Caston's Role
Caston provides technological infrastructure connecting candidates and industry professionals. Caston is not an employer, talent agency, casting director, producer or a party to contracts between candidates and Professional Users.
17. Liability
Professional Users are responsible for their own unlawful conduct and use of the Platform in violation of this Agreement. Unauthorized or unlawful use of candidate data may result in liability under applicable law for losses or damages suffered by Caston, candidates or third parties.
18. Termination
When professional access ends, the right to use the Platform also ends. Professional Users must delete or destroy personal data obtained through Caston where there is no longer a lawful basis for retention, subject to applicable legal requirements. Provisions intended to survive termination remain effective.

19. Changes to this Agreement
Caston may update this Agreement due to legal, technical, security or operational requirements. Material changes may require Professional Users to review and accept the updated Agreement before continuing access.
20. Governing Law and Jurisdiction
This Agreement is governed by the laws of the Republic of Türkiye. Unless otherwise required by mandatory law, the Istanbul Anatolian Courts and Enforcement Offices shall have jurisdiction.
21. Electronic Acceptance
A Professional User may accept this Agreement during first login by selecting 'I Agree', 'Accept' or another equivalent electronic mechanism. Caston may retain records of the user account, date/time of acceptance and version accepted in accordance with applicable law.
